Telecommunications Code Powers Advice

The UK government amended the Electronic Communications Code as part of the Digital Economy Act 2017. The ‘new Code’ is found in Schedule 3A of the Communications Act 2003 and is the principle legislation that governs the relationship between electronic communications apparatus and land.

The Code sets out explicitly what mobile operators, network infrastructure providers, landlords and site providers can and cannot do when dealing with electronic communications apparatus on land and buildings.

The Electronic Communications Code is to be considered when any Code operator wants to install, upgrade or relocate their apparatus, as well as vary or renew their contractual agreement.

The amended Code grants operators broader rights, making it easier for them to access privately owned land compared to the old legislation. Property owners planning future developments should carefully consider any approaches from operators and should seek professional and legal advice before engaging with the operator.
